Working With UK Trading Standards & Market Surveillance Authorities

UK Trading Standards and EU Market Surveillance Authorities ensure that products on the market meet regulatory requirements. If a concern is raised, they contact the appointed Responsible Person and that’s where Expandly steps in.

Case Study 1: Food Supplement Flagged as a Novel Food in Austria

A food supplement sold by one of our clients was flagged by Austrian authorities as potentially containing a novel food ingredient.

A novel food ingredient is a food or food ingredient that has not been significantly consumed by humans in a particular region before a certain date and may require regulatory approval before being sold. These ingredients are considered “new” to the diet of the population and could include innovative or unusual products.

What was the issue...

  • Austrian authorities raised a concern with UK Trading Standards.
  • Trading Standards contacted Expandly as the client’s appointed Responsible Person.
  • Inspectors visited Expandly’s registered UK address – the same address listed on the product label – and requested full compliance documentation for the product.

Expandly’s compliance team investigated...

  • The label report and supporting documentation collected during onboarding were provided immediately.
  • A review of the ingredient revealed two different forms, confirming that the form used in the product was not classified as a novel food and this was highlighted during the label reviews.

Positive Outcome for Client...

  • The authorities accepted the findings
  • The product was cleared for sale
  • The listing was reinstated and returned to the marketplace

Case Study 2: Electrical Product Flagged for Incorrect Labelling

What was the issue...

  • An electrical product sold via a competitor’s 3PL was flagged as non-compliant due to incorrect labelling.
  • The product was removed from sale.
  • The client sought expert compliance support from Expandly.
  • Expandly was asked to carry out a Root Cause Analysis and resolve the issue.

How Expandly’s compliance experts resolved the issue...

  • Liaised directly with contacts at UK Trading Standards.
  • Reviewed the original reports and findings in detail.
  • Identified the compliance gaps and their root cause.
  • Delivered a clear, actionable plan to the client.
  • Prepared updated supporting documentation.
  • Managed re-labelling of products and packaging.

Positive Outcome achieved...

  • Compliance issues fully resolved.
  • Documentation approved by authorities.
  • Product reinstated and back on sale.

How Expandly Supports You Beyond Launch

Compliance doesn’t stop once your product is listed, and neither does support. Expandly provides end-to-end guidance to keep your products compliant and your business running smoothly.

If a product is flagged or removed from sale, a Root Cause Analysis is carried out with the authorities, corrective action plans are agreed and implemented. Ongoing representation with UK Trading Standards, support with Market Surveillance, and guidance as regulations evolve mean that if authorities contact you, they contact Expandly – and the issue is handled on your behalf.
